Damage claim delayed

At the end of Monday’s council meeting, Mayor Butch Berry said that Larry Burkett claimed an overhanging limb on Mountain Street knocked off the side mirror of vehicle as he drove by. Public Works staff subsequently cleared limbs in that area, so the adverse limb was no longer available, and it was not determined whether the limb came from a city-owned tree.

Berry said the city has paid for certain claims in the past even though tort immunity applied. The complainant was not present, so council eventually voted to defer a decision until Burkett and someone from Public Works could be present.

In Public Comments, Bob Jasinski again claimed proposed Ord. 2269 went against State Code because it altered an ordinance that copied exactly a portion of State Code. He also said there had been comments that no one showed up for public hearings called by the Planning Commission, but insisted the notice of the hearing was deficient on several points and would not stand against a court challenge.

  • Alderman Mickey Schneider claimed the Eurekan Multi-Sport event held last weekend is drawing more attention than ever, and participants came from 16 states from Washington to Florida and Puerto Rico. Also represented were Spain, Argentina and Hong Kong. She said more than 90 percent of the participants came from outside the local zip code.
  • Alderman Bob Thomas presented a March 1 article from 3PlayMedia that noted, “For a small town of around 2000 people, Eureka Springs, Arkansas, is still doing better than most municipal governments out there when it comes to captioning their videos.” Thomas said Eureka Springs came in third in the prestigious list, and he acknowledged Mayoral Assistant Kim Stryker, Building Manager Don Matt, and videographer David Rush for their work.

Next meeting will be Monday, August 27, at 6 p.m. A budget workshop will convene at 5:15 p.m.
